Section 889 of the 2019 National Defense Authorization Act prohibits the sale and use of any equipment or service that uses either “covered telecommunications equipment or services as a substantial or essential component of any system” or as “critical technology as part of any system.” Section 889(a)(1)(A), focused on sales of covered equipment/services, went into effect in August 2019. Section 889(a)(1)(B), focused on use of covered equipment/services, went into effect in August 2020, although Department of Defense contractors have a one- month extension to September 30, 2020.

Companies are currently grappling with the complex requirements of Section 889 and its implications for all aspects of the business. The webinar will help companies understand how to conduct a “reasonable inquiry” of their telecommunications equipment/services, explain the definition of “use”, and the elements of an effective Section 889 compliance program, including how companies should work with their suppliers, service providers, and vendors.
