Clayton Gerber is a Managing Director at Ankura, based in Washington, DC. Clayton has over 20 years of experience, leading some of the largest and most complex national and transnational white-collar investigations, involving concurrent civil, criminal, and administrative actions. Clayton has engaged with numerous U.S. enforcement agencies, including the U.S. Department of Justice (DOJ), the Office of Foreign Assets Control (OFAC), the Securities and Exchange Commission, the Federal Trade Commission, as well as foreign law enforcement and prosecution services around the globe. He specializes in investigating bank, wire, and mail fraud, money laundering, and other related criminal activity.
Experience
Before joining Ankura, Clayton was a postal inspector/team leader with the U.S. Postal Inspection Service. He led a team of federal investigators and analysts embedded in the Fraud Section and the Consumer Protection Branch at the DOJ. In those roles, he conducted or supervised a wide variety of investigations, involving investment schemes, market manipulation, accounting fraud, consumer fraud, and money laundering. He has testified in federal court numerous times, and his investigations resulted in 10 successful jury verdicts at trial, including in a case involving a $5 billion fraud loss.
Clayton has advised on matters related to the U.S. Postal Service, mail tracking data, timely delivery, and counterfeit postage. He is an expert in the collection and exploitation of digital data. He has extensive experience exploiting existing data sets, both structured and unstructured, to identify previously unseen weaknesses and vulnerabilities. He specializes in identifying alternative resolutions in lieu of criminal enforcement. Clayton is an international speaker/instructor on white collar crime and investigations.
Examples of Clayton’s professional experience include:
- Investigated numerous investment schemes, including unlicensed commodity pool operators and a multi-billion-dollar transnational Ponzi scheme.
- Conducted numerous financial investigations involving foreign financial institutions’ transfer of U.S. Dollar funds both through U.S. based correspondent banks as well as alternative transfer networks.
- Conducted concurrent criminal and civil investigations into entities and individuals who were listed on OFAC’s Specially Designated Nationals list.
- He has been issued a license by OFAC to hold sanctioned assets. He has conducted investigations into financial transactions by foreign nationals that appeared to violate U.S. sanctions.
- Investigated and audited retail finance units for theft and loss, including employee theft, collusion, and circumvention of established controls and protocols. Conducted physical and personnel security reviews.
- Conducted internal investigations into embezzlement and internal theft, and prepared associated proof of loss submissions.
- Managed numerous Foreign Corrupt Practices Act investigations and the associated cash-tracing and improper flow of funds through intermediaries.
- Managed an investigation into a publicly traded company that engaged in various accounting fraud schemes to inflate revenue to meet expectations.
- Conducted and managed numerous insider trading and spoofing investigations.
- Conducted numerous investigations into banks to determine if they knowingly or unknowingly facilitated fraudulent payments through their hosted third-party payment processor relationships. This included the identification of weaknesses in their Know Your Customer and anti-money laundering oversight.
- Led the investigation into a global payment processor who knowingly facilitated payment processing for criminal enterprises and assisted in laundering the illicit proceeds.
- Led the investigations into several data brokers who sold consumers’ personal information to criminal enterprises.
