Eric Goldman is a Managing Director at Ankura based in Fairfield. He has fifteen years of experience in construction management, architectural design, schedule advisory and forensic analysis, and construction disputes on a range of residential, civic, energy, and roadway projects. His construction management history includes large institutional projects, as well as single and multi-family residential. Eric has performed schedule and budget monitoring, as well as preparation and analysis of various schedule delay, acceleration, loss of productivity, cost overrun, and construction defect claims on construction projects.

Experience

Eric’s professional experience includes:

  • Residential development projects in New York and Connecticut: Eric is providing construction management advisory services to clients’ real estate portfolios, with construction budgets ranging from $5-$25 million. Acting as an owner’s representative, he manages project budgets and invoice approval, coordinates the design and construction team members, and provides technical consulting on behalf of the owner/client.
  • Central Connecticut State University (CCSU) Dormitories Dispute: Eric assisted the architect in defending against a claim from the contractor responsible for new dormitory construction. Eric analyzed and reviewed the changes to the MEP scope between conceptual design used for lump sum proposal and permit set drawings to develop defense strategies against this claim.
  • The Norwalk Hospital Association Standard of Care Dispute: Eric utilized his architectural background to determine potential architectural liability for standard of care. The project included an expansion of ambulatory, surgery, and cancer services to an existing hospital, including full interior fit-out. Eric’s analyzed document deficiency and architect error and/or omission to assist the client’s exposure liability and facilitate settlement proceedings.
  • Rialto Capital Project in New Jersey: Eric provided on-site observation of the selective testing for exterior brick facade and window functionality. A team was retained by the architect’s counsel to analyze claims being brought against them by the insurance company. Eric assisted the team in the observations and documentation of field water tests and is providing additional contemporaneous documentation review.
  • Educational Institution Performing Arts Center in New York: Eric assisted the architect of record and its counsel regarding alleged claims of professional negligence. He reviewed project change orders to determine document deficiency and architect error and/or omission in the fast-track construction project. Eric prepared timelines of events based on architectural bid package releases in conjunction with additional contemporaneous documentation. The timelines were a pivotal part of the E&O analysis and mediation proceedings.
  • New York State University Construction Fund projects: Eric is assisting the State University Construction Fund (SUCF) in disputes between the contractors and SUCF on two multi-prime new medical buildings at State Universities of New York. Eric is part of the delay analysis team who is reviewing the analyses and alleged issues as presented by the contractors as well as performing critical path analyses to interim and final milestones.
  • Ongoing on-call services to the Connecticut Department of Transportation including analysis of construction claims and schedule advisory services.
  • Connecticut Department of Transportation (DOT) New Haven Rail Yard Component Change Out Shop (CCO): Eric worked as a consultant providing schedule analyses for claims arising from the construction of the CCO, a 293,000 square foot main shop and office complex for the New Haven Rail Yard. The construction project experienced schedule delays and cost increases for which the team provided the Connecticut DOT advisory and claims services including schedule update review and forensic analysis.
  • Ongoing Dispute – Redevelopment Project in New York City: Eric is assisting the New York City Law Department in defending delay and disruption losses alleged by the developer. This matter led to the writing of an expert report for which trial is pending.
  • Massachusetts Bay Transportation Authority (MBTA) Transit Line Expansion: Eric performed an interim schedule analysis to assist in time extension negotiations for the sub-prime contractor working on a $2.3 billion dollar transit line expansion project. Further, the contractor enlisted Ankura’s additional service for proactive maintenance of the cost loaded schedule for monthly updates to achieve reporting and invoicing requirements.
  • Mixed-Use Development Project in Cambridge, MA: Eric was engaged by the contractor in dispute with the developer over design impacts and extended performance of work resulting in delayed project completion. Eric performed a review of change orders, manpower, and third-party utility service impacts to inform a forensic schedule analysis presented via demonstratives and an issued written report. As the designated testifying expert, Eric assisted at mediation and the eventually settlement.
  • University Recreational Fields Development Project in Boston, MA: Eric is assisting the general contractor in developing their request for equitable adjustment to the University (owner) for direct and schedule related damages. He developed a windows schedule analysis to identify the impact of delayed utility re-routing and design discrepancies, unforeseen unsuitable soils and stockpiling issues, and extreme weather impacts. Additionally, Eric provided litigation support through settlement.
  • Resort and Casino Project in Nassau, Bahamas. Ankura was engaged by counsel to a developer to evaluate the construction manager’s performance during $3.5 billion construction project. The project consisted of four separately branded hotel towers; shared podium mixed use spaces; convention center; and other amenities. Eric assisted in the evaluation of the contractor’s performance on the project against its contractual requirements and generally accepted industry practices for managing and coordinating work, scheduling, and reporting. Eric and the project team also evaluated the contractor’s performance against commitments made to the developer to increase its labor, productivity, and project management staff in a failed attempt to achieve the resort opening date. Eric provided litigation support in the New York City-based trial.
