Richie specializes in conducting large-scale financial investigations and performing complex cash and asset tracing techniques. He also has extensive experience providing forensic accounting, expert witness, and litigation-related services in connection with high-profile bankruptcy cases and distressed company situations.
- Forensic Accounting and Investigations: Richie has extensive experience uncovering financial and accounting fraud schemes, investigating allegations related to misappropriation of assets, digital counterfeiting, and computer crime schemes, conducting fact finding investigations, performing flow of funds, and cash tracing analyses, analyzing intercompany accounts, identifying undisclosed related party transactions, investigating allegations related to alter ego and veil piercing, and analyzing a company’s ability to pay and quantifying damages.
- Bankruptcy Investigations and Litigation: Richie has been involved in complex bankruptcy cases involving insider investigations, preference and fraudulent conveyance actions, solvency and valuation issues, breach of fiduciary duty claims, intercompany and inter-creditor disputes, substantive consolidation, equitable subordination, loan recharacterization, and Ponzi schemes.
Richie’s financial investigation and litigation engagement experience includes:
- Forensic accountant and expert witness to a Chinese company, partly owned by the Chinese government. Expert report and declaration included describing the company’s complex corporate organizational structure and corporate formalities observed, as well as analyzing the company’s ability to pay a large civil judgment.
- Forensic accountant to Ambac Assurance in connection with alter ego and veil piercing claims against Bank of America and Countrywide.
- Forensic accountant performing global asset searches, cash tracing analyses, and investigating allegations of computer crime related to a digital counterfeiting scheme.
- Forensic accountant in white-collar crime cases involving allegations of fraud, embezzlement, misappropriation of assets, and money laundering.
- Forensic accountant in Securities and Exchange Commission enforcement actions and Department of Justice criminal matters involving allegations of accounting fraud, insider trading, selling of unregistered securities, and bid rigging.
- Financial expert involved in issues related to the quantification of damages, valuation, and liquidity.
Richie’s bankruptcy investigation and litigation engagement experience includes:
- Forensic accountant and testifying expert to the Special Committee of the Board of Directors of Purdue Pharma Inc. Testimony and analyses included the identification and quantification of more than $10 billion in cash transfers of value made by the debtors to or for the benefit of parent entities, shareholders and/or Sackler Family members, and/or any other entity in which beneficial owners or Sackler Family members own a controlling interest.
- Forensic accountant and testifying expert to the Independent Directors of Mission Coal’s Board of Directors. Testimony and analyses included quantifying the damages related to potential causes of action against numerous insiders and third-party lenders.
- Forensic accountant and expert witness to the Unencumbered Assets Trust and VI/XII Collateral Trust (re: NCFE Chapter 11). Expert report and underlying analyses included tracing the amount of funds that flowed through and remained on deposit in certain bank accounts by applying the Lowest Intermediate Balance Test, and describing normal key documents that one would expect to find memorializing an asset-based revolving line of credit, as compared to the way parties typically document the sale and purchase of accounts receivable.
- Forensic accountant and/or expert witness to the special committees and/or independent director(s) of the board of directors of Cenveo, GOL Airlines, Maxus Energy, Prima Wawona, Sabine Oil & Gas, and Vyaire.
- Forensic accountant to the official committee of unsecured creditors and/or bondholders of Accuride, Ascend, Benefytt, Boy Scouts, Century 21, Chesapeake Energy, Commonwealth of Puerto Rico, Enviva, Exide, FedNat, Fusion Connect, GWG, Haggen, Legacy Cares, Modell’s, NCFE, New Century Financial, New Stream Secured Capital, Rite Aid, Trident, Vertex, and Windstream.
