Navigating a Nuclear Power Plant Delay Dispute

A major contractor for a nuclear power plant construction project was responsible for delivering one of the key mechanical packages and associated infrastructure for the project. A delay of several years resulted in a significant cost overrun. Ankura worked on-site with the contractor client team over a period of months to provide analysis and reports that were used by counsel to formalize and prosecute the claim. The report was used by the client as an instrument for renegotiating the terms of its contract governing the scope of work to completion.

Settling a Dispute Over Scope Creep and Project Delays

The contractor was appointed as a subcontractor to perform electrical; mechanical and instrumentation installation works on a remote Australian project. There was significant growth in their scope of work as well as numerous variations, late delivery of the free-issue materials including modules from overseas with fabrication and design defects. Ankura worked with the client team (including periods in their offices), to provide analysis, remeasurement, and reports that were used by counsel and the client for negotiation and ultimate settlement of the dispute before the hearing.

Resolving a Dispute Over the First Semi-Submersible Floating Production System in South East Asia

After the operator/lessor of a semi-submersible floating production system (FPS) suffered significant delays to the commissioning of the project and incurred losses resulting from rectification of defects discovered after float-out, an Ankura expert opined on the causes and extent of the delay, disruption, and quantum, which assisted the tribunal in ruling in favour of the operator’s claims. The Semi-FPS in question is the first facility of its kind built to operate in the 1,200-metre-deep water, part of the South East Asia exclusive economic zone, weighing approximately 37,500 metric tonnes.
