As a Managing Director in Ankura’s Los Angeles office, Jeremy Guinta plays an integral role in advising trial attorneys on economic and damage calculations and complex data related to disputes. He has nearly 20 years’ experience in litigation consulting and complex data analysis. Jeremy specializes in performing data analysis, including complex statistical procedures to develop trends and predictive analysis.

Experience

Jeremy has consulted with some of the leading trial attorneys and top litigators in the United States to assist them with data management, complex data analysis, and calculation of damages. Typically, Jeremy executes engagements under privilege, but he also supports expert testifiers with the analysis and synthesis of complex data.

Jeremy has managed, analyzed, and calculated damages for a wide variety of cases, including discrimination, wage and hour, consumer protection, and general class action defense. He has also performed complex regression analysis assessing adverse impact across protected classes. Additionally, Jeremy has analyzed class certification issues on various engagements and prepared specific analyses to show how individualized inquiry was necessary. He has also prepared specific statistical tests to demonstrate that class members are statistically different from one another.

Jeremy has extensive experience in False Claim Act litigation and federal whistleblower matters. He retains a wide variety of technical skills and tools used to perform his work. Jeremy is an expert programmer and database administrator in SQL and an expert programmer in R. He has also developed and delivered a national training curriculum based in R. As the lead instructor for these trainings, Jeremy has successfully instructed on data management, statistical analysis, and data visualization techniques.

Jeremy’s professional experience includes:

  • Employee Discrimination: Analyzed human resources data related to a reduction in force by a major auto parts manufacturer that the plaintiffs contended was discriminatory.
  • Employee Discrimination: Prepared analysis to assess the potential liability of non-exempt employees in a class action labor dispute concerning gender pay discrimination.
  • Lost Wages & Wrongful Termination: Computed damages related to claims of age discrimination on behalf of anesthesiologist medical group. Analyzed the claims and performed economic research to develop a rebuttal damage model.
  • Lost Wages & Wrongful Termination: Analyzed claims of alleged environmental contamination that plaintiffs contend had physically harmed them and prevented them from obtaining gainful employment. Jeremy conducted economic analysis and developed a damage model for lost wages.
  • Wage & Hour: Replicated a major hotel chain’s payroll database and utilized all available data to compute meal and rest break violations and penalties in accordance with state law.
  • Wage & Hour: Conducted a multi-state, cross-jurisdictional investigation of a major United States retailer’s point-of-sale, inventory, and training system data along with the timekeeping system to determine unlawful off-the-clock hours worked by employees
  • Class Action: Designed a database system to warehouse a major bank’s entire advertising campaign database. Linked that database to advertising sent to consumers and tracked when and who saw specific advertising pieces. Analyzed the differences across advertising sent to consumers and identified key trend differences across putative class members.
  • Class Action: Reviewed, processed, and analyzed dialer and leads records in excess of 500 million observations from a national insurance agency facing Telecommunication Consumer Protection Act (TCPA) violations. Rebutted plaintiffs’ expert’s opinions regarding the number of calls made.
  • Class Action: Analyzed delivery records maintained by a major restaurant. Computed driving mileage per delivery and assessed if delivery drivers could have been properly reimbursed based upon their driving habits. Developed an individual cost model that demonstrated that under different circumstances, drivers, mileage and make and model of the car reimbursements could vary significantly.
  • Statistical Analysis: Designed, trained, and tested a supervised Machine Learning algorithm to assist with the review of names across multiple data sources and to determine whether a name in one data source matched a name in a different data sources.
  • Statistical Analysis: Conducted regression analysis to assess the impact of a major grocery chain’s bonus and compensation plan was based on the employee’s annual performance rating. Determined if an employee should have received a bonus based on their performance while controlling for other key factors (such as job title and tenure) and calculated the predicted value of the bonus for each employee.
  • Government: Jeremy led a team retained by a major entertainment company to perform a detailed transactional review of expenses in China related to various entertainment ventures conducted by the company facing Foreign Corrupt Practices Act allegations.
  • Government: Analyzed data from a major Prime Vendor food supply and distribution company facing False Claims Act allegations made in Qui Tam complaint that was joined by the United States Government. Designed and conducted analyses that used sales and pricing data to develop trending analyses that showed market fluctuations of prices over time and timely payment of invoices and utilized graphical representations of the data to rebut the government’s allegations.
