SaaS and eDiscovery – Navigating the Challenges of Emerging Data Sources

Collaboration and communication technology forms have evolved considerably within the past 3 years. Traditional business environments across the United States and Globally are now utilizing heightened communication forms such as Slack, Quip and WhatsApp to increase chat efficiency and foster creative environments to encourage productivity. Technology hubs such as Silicon Valley are no longer isolated instances of communication technology variance. With this heightening and continued introduction of numerous forms of communication, new challenges have been raised during identification, collection and production of these non-standard data types for investigations and lawsuits. This program will use a hypothetical lawsuit where a team of engineers have been using three forms of emerging data sources for communication, which will need to be preserved, collected, reviewed and produced per the request for production from plaintiffs’ counsel. We’ll navigate the process, considerations and risks while we navigate this hypothetical scenario.
Supporting CA Privacy Compliance with Effective Records Management

Starting in January of 2023, businesses subject to California Privacy Rights Act (CPRA) may be required to publish the retention periods for all categories of personal and sensitive information they collect, manage, store, share, or sell. CPRA Section 1798.100. General Duties of Businesses that Collect personal information states that businesses subject to CPRA need to disclose:
“The length of time the business intends to retain each category of personal information, including sensitive personal information, or if that is not possible, the criteria used to determine that period provided that a business shall not retain a consumer’s personal information or sensitive personal information for each disclosed purpose for which the personal information was collected for longer than is reasonably necessary for that disclosed purpose.”
In this session, we’ll provide guidance on how to develop a functional records management program to support compliance with this requirement of the CPRA. Companies should start by considering the overall records management environment, including:

• Data Retention Schedule
• Change Management Strategy
Cybersecurity: What Every RIM Professional Needs to Know
Presenters: Jason Straight and Joe Shepley
Cybersecurity can be an arcane, overly technical discipline, but the goals of cyber align closely with the goals of good RIM practices. In this session, you’ll learn what your CISO prioritizes, how she approaches her work, and how you, as a RIM professional, can support it. We’ll first define “cyber”, then outline why your cyber colleagues are important allies in fostering strong RIM capabilities, then close with a consideration of the key cyber topics and domains that every RIM professional needs to be familiar with to not only add value to their cyber colleagues, but to piggyback on the attention paid to cyber to achieve RIM objectives.
