Marshall’s professional experience includes:
- New York High-End Hotel / Residential High-Rise Conversion: Provided schedule advisory services to the developer for the repositioning of a 1.65 million-square-foot, 46-story landmarked hotel to a mixed-use property including a 375-key hotel and two towers featuring 375 high-end condominiums.
- West Coast Mixed-Use High-Rise Construction: Retained to advise and manage risk for the construction manager during construction of a 1.5-million-square-foot multi-tower development consisting of high-end residential, five-star hotel, retail, and amenities components.
- New York Luxury Residential / Boutique Hotel High-Rise Construction: Provided advisory services for the developer, including development and maintenance of completion schedules for the hotel and residential components of the project to streamline stakeholder assessment.
- New York Airport Terminal Redevelopment: Provided project controls assistance to the owner on a $4 billion, 1.3-million-square-foot program. Worked with the construction management team to assess the support and validity of change order requests submitted by prime contractors. Led meetings with the project team to resolve change orders.
- Ultra High-End Private Residences: Assisted family offices and contractors with project schedule advisory, baseline schedule development, and schedule updates/monitoring for several residences, including multi-level penthouse apartments and campus-style homes, with sizes ranging from 25,000 square feet to more than 70,000 square feet.
- West Coast High-End Residential Building: Engaged by the construction manager to provide support throughout the dispute resolution process, including delay claim preparation, mediation, and arbitration. Issued an expert report and a rebuttal report regarding schedule delays. Testified at arbitration.
- Midwest High-Rise Government Office Building: Analyzed delays to the concrete scope and identified periods when the concrete scope impacted the overall project. Analyzed the concrete contractor’s cost reporting to identify drivers of major cost variances. Presented analysis and assisted during mediation and settlement negotiations.
- West Coast Adaptive Reuse Hotel High-Rise Project: Engaged by subcontractor to issue an expert rebuttal report responding to the opinions presented by the owner’s delay expert in an arbitration. Prepared a delay analysis using the general contractor’s project schedules and assessed the opposing delay expert’s conclusions.
- Residential Low-Rise Complex and Parking Garage: Assisted with the development of an expert report covering delay and damages claimed against the developer and the general contractor on behalf of the concrete subcontractor. Supported counsel’s depositions of opposing experts and preparations for arbitration hearings.
- Courthouse: Performed a schedule analysis, analyzing delays incurred by the mechanical, electrical, and prime (MEP) contractors on a 775,000-square-foot courthouse, and analyzed costs associated with alleged MEP-related building deficiencies. Assisted the construction manager and its attorneys throughout months of mediation with several prime contractors.
- Overseas U.S. Government Construction: Prepared a delay analysis, assisted with an expert report, and supported a first-chair testifier during arbitration hearings related to the construction of six new building structures on 25 acres.
- Natural Gas Processing Facility: Assessed claims made against the mechanical contractor by the project’s developer and engineering, procurement, and construction contractor. Assisted with preparing an expert report and a rebuttal report regarding the opposing expert.
- 700 MW Coal-Fired Power Plant: Analyzed design-build consortium’s delay and damages claims and developed schedule delay analysis to substantiate affirmative claims for liquidated damages. Assisted with the preparation of an expert report and rebuttal reports refuting the opinions of opposing cost and schedule experts.
- 817 MW Natural Gas-Fired Combined Cycle Power Plant: Assessed contractor’s claims for delays, productivity impacts, and unpaid changes. Led the review and rebuttal of the contractor’s expert opinions and supported three Ankura experts in developing a rebuttal report in advance of mediation.
- Manhattan Office Tower Deconstruction: Led labor productivity analysis and leveraged results to quantify critical path schedule delays. Assisted with the preparation of an expert report and rebuttal reports refuting opposing experts.
- Ship Construction Project: Engaged to quantify the additional costs/damages and critical path delays suffered by the constructor during manufacture of three 140,000-cubic-foot sludge ships. Assisted with the preparation of an expert report and rebuttal report. Quantified damages owed to the contractor and analyzed the contractor’s labor inefficiency.
