Tim Cradock is a Managing Director in the global construction practice of Ankura Consulting, based in Hong Kong. He has been appointed and cross-examined as a quantum expert in arbitration and has advised on some of the region’s most complex infrastructure, energy, and building disputes.

Experience

Tim commenced his career in the UK and has over 22 years of industry experience, including 16 years working internationally. This includes four years in the Middle East and the past 12 years based in and around Asia.

He has an extensive portfolio of international project experience spanning airports, buildings, power plants, offshore oil rigs and drilling units, liquified natural gas pipelines, and high-rise and mixed-use developments across Asia, Europe, the Middle East, and Australia.

In addition to his own expert appointments, Tim has acted as an expert advisor on numerous international disputes, supporting the preparation of claims and working closely with clients’ legal counsel to prepare submissions, expert reports, and provide support to testifying experts in arbitration and other Alternative Discipline Process proceedings.

Tim has also been mentioned in Lexology Index (formerly Who’s Who Legal) in the category of Experts for “Arbitration” and “Mainland China, Hong Kong SAR and Macao SAR” and is quoted as being “a rising star in the arbitration expert field” and someone that impresses market sources with his “diligence, prompt turnaround time and objective practical advice on quantum matters.”

Tim’s professional experience includes:

Hotel, Hong Kong – Appointed as the quantum expert on a disputed final account on a hotel refurbishment in Hong Kong.

Road Project, Hong Kong – Appointed as the quantum expert on a prolongation claim by a specialist subcontractor arising out of the construction of a large road tunnel in Hong Kong. The work included the assessment of the subcontractors’ costs during the delay period.

Office Building, Hong Kong – Appointed as the quantum expert on a termination claim by the employer on a building project in Hong Kong. The work currently includes the assessment of the contractor’s subcontractor’s claim and input into the Statement of Defence.

Rail Project, Malaysia – Appointed as the joint-named quantum expert on a termination claim by a main contractor. The work includes the remeasurement and valuation of the work up to the date of termination, the assessment of loss and expense during a suspension period, the assessment of costs following the termination, and the valuation of the main contractor’s loss of profit. This matter was settled following the submission of expert reports.

Hotel, Singapore – Appointed as the quantum expert for a nominated fitting out subcontractor for the assessment of acceleration, prolongation costs, and disruption costs. The work included the verification of the acceleration costs, the detailed preparation of the prolongation costs, including preparing a Head Office Overhead assessment, and the assessment of the cost per day for disruption. The matter was finally determined by arbitration and involved a four-week trial where Tim gave oral evidence under cross-examination. The tribunal accepted his evidence.

Hotel Project, Malaysia – Appointed as the quantum expert on a disputed final account by an employer. The work included the valuation of various value objects, abortive and remedial works, and the assessment of loss and expense claimed by the main contractor and counterclaims from the employer.

International Airport, Middle East – Lead assistant to the named expert on a multi-billion-dollar termination claim on an airport in the Middle East. The matter involved the assessment of prolongation, disputed variations, COVID-19-related costs, and subcontractor claims.

Rail Project, Middle East – Expert advisor on the preparation of detailed claims for prolongation, disruption, and remeasurement and valuation of variations associated with work on the viaduct and the stations on behalf of the main contractor on a multi-billion-dollar rail project in Saudi Arabia. The work involved the identification of the relevant heads of claim, the remeasurement of various areas of work, and presentations for negotiations with the employer.

Rail Project, Dubai – expert advisor to the employer for acceleration, disruption, escalation, and preferential engineering claims submitted by a joint venture contractor on a multi-billion-dollar rail infrastructure project in Dubai. The work involved interdependently determining the proper valuation of the claim, working alongside external lawyers and counsel. The contract form was the International Federation of Consulting Engineers (FIDIC) red book.

Residential Development, Hong Kong – Lead assistant to the named expert on the valuation of prolongation costs, variations, and the cost of significant remedial works on a prestigious development in Hong Kong. The work involved the assessment of the contractor’s claims for prolongation, variations, and the reasonableness of the rectification works carried out by the client. The matter was finally determined by arbitration, and Tim attended and assisted during the oral hearing.

Residential Development, Dubai – Expert advisor for a contractor on a multi-million-dollar dispute following the unlawful termination of a development in Dubai. Works included the remeasurement and valuation of works up to the date of termination and the assessment of loss of profits. The contract form was the FIDIC red book.

Hotel Development, UK – Expert advisor appointed to review and provide opinions on various claims submitted to the employer on a major five-star hotel development in central London. The work involved reviewing the merits of the consultant’s claims and providing an independent report on the valuation. The contract form was bespoke, and the disputed value was approximately GBP10 million. The matter was settled by negotiation.
