Experience

After gaining all round experience in the construction industry in a variety of procurement frameworks ranging from traditional to collaborative, Nik specialises in providing expert programming, time management, and works progress related advice. Nik has provided testimony in adjudications and international arbitrations and has been appointed as a party expert, has been appointed jointly by the parties and has provided written assistance in proceedings including litigation, international arbitrations, and adjudications.

Nik’s professional experience includes:

  • Expert appointment in an international arbitration arising under the three contracts for major road regeneration and development in Kazakhstan (under SIAC rules).
  • Exert appointment analysing incidents and extent of delays during the construction of a new jetty serving a gas terminal in Iraq, including testimony at the hearing (DIAC, UAE).
  • Expert review of the EPC contractor’s claim for extension of time arising out of the contracts to construct 2.1 billion refinery (contact advice, Oman).
  • Provision of expert programing review including evaluation of options going forward and advice on potential time recovery in respect of off-shore gravity-base structure undergoing construction in Canada (project advice).
  • Expert appointment including preparation and submission of the report analysing project delays accrued on a project to build 10 level residential care home building and commercial units in West London (adjudication, England and Wales).
  • Expert appointment including preparation and submission of the report analysing project delays accrued on a project to redevelop a listed building in to a hotel in West End London (adjudication, England and Wales).
  • Joint expert appointment by the parties involved in a dispute over an extension of time entitlement arising out of the contract to construct a new build retail park and its supporting infrastructure in central London (contract advice, England and Wales).
  • Expert appointment including preparation of the report and provision of oral assistance in a meeting analysing project delays and in concurrent delays under a stand-alone enabling works contract to divert the existing services to allow a major high-rise development to proceed.   • Provision of programing status review and expert advice including evaluation of options going forward and advice for potential project recovery on 120 km long segment of a motorway in North Africa comprising eight viaducts and 20km of areas vulnerable to flooding requiring procurement, delivery, and construction of flood defensive measures and materials (project advice).
  • Expert appointment to provide programming review and analysis of programming status, causes of delay, critical path identification, projections for going forward, and turn around advice on a coal to biomass fuel refurbishment of power plant in UK (project advice).

  • Provision of lead assistance during preparation of planning and programming report and presentation of expert evidence, including rebuttal report, joint expert statement, support during the oral testimony, cross‐examination, and production of a counterfactual analysis directed by the court in a matter involving procurement of off-shore wind power farm in the UK (Technology and Construction Court London).

  • Lead assistance in a review of delay analyses and other programming evidence provided during the proceedings on behalf of both the claimant and the respondent during the arbitration in connection with a major road project in the Middle East. The review included extensions of time entitlement evaluation under the back to back provisions between the main contract and one of the subcontracts (ICC Doha).
