Scott Jardine is a Senior Managing Director at Ankura, based in London. He is a Chartered Civil Engineer with over 30 years of experience advising on complex capital projects and disputes.
Scott is an experienced independent delay expert witness, having been appointed on over 90 occasions across construction, engineering, and technology disputes. He has given oral evidence and been cross-examined more than 20 times in arbitrations and high court proceedings. He is recognised for his ability to explain complex delay analysis issues clearly under cross-examination.
Experience
Scott advises public and private sector clients on project delay, contract termination, and dispute readiness. He undertakes detailed project reviews to assess the merits of delay claims and provides strategic advice on dispute resolution options.
His experience spans a wide range of sectors, including power, oil and gas, marine engineering, shipbuilding, defence, nuclear, rail, infrastructure, healthcare, technology, and high-end residential developments, both in the United Kingdom (UK) and internationally.
He has been appointed in proceedings before the English High Court (TCC), as well as in London Court of International Arbitration, International Chamber of Commerce (ICC), and Dubai International Arbitration Centre (DIAC) arbitrations, dispute adjudication boards, and mediations. He also undertakes independent merit reviews and advises insurers on delay-related claims.
Scott’s professional experience includes:
- Acting as independent delay expert witness in complex disputes, undertaking detailed delay and disruption analysis using both established and bespoke methodologies.
- Providing strategic advice on dispute preparation, including termination scenarios and formal proceedings.
- Supporting clients in developing project controls, procurement strategies, and risk management frameworks.
- Designing and implementing programme management systems using critical path analysis tools and bespoke databases.
- Applying earned value analysis techniques to support project control and financial reporting.
Scott’s selected contentious construction, information technology (IT), and engineering experience includes:
- Pension Data IT Transformation Project – UK: Appointed as independent delay expert in high court litigation concerning delays to a major IT transformation (Tata Consultancy Services v. Disclosure and Barring Service; case No: HT-2020-000448).
- Energy From Waste Plant – UK: Appointed as independent delay expert in high court litigation concerning delays to the construction of an energy from waste plant (Energy Works (Hull) Ltd v. MW High Tech Projects UK Ltd; case No: HT-2019-000259.
- Chemical Plant – Caribbean: Acted as the delay expert in ICC arbitration, addressing delay issues, including force majeure events, COVID-19 pandemic impacts, and commissioning delays.
- Oil and Gas Project – Norway: Appointed as the independent delay expert to report on the delay and disruption suffered by the contractor on the refurbishment of a mobile offshore drilling and production unit.
- Shipbuilding Project – the Middle East: Appointed as the independent delay expert for a DIAC arbitration on a dispute between an owner and the builder of a ship.
- Luxury Residential Development – London: Acted as the delay expert in a dispute between a contractor and developer on a multi-million pound “high-end residential” project in London.
- International Power Station Project – the Middle East: Advised on delays to a 1,600 megawatt project.
- Prestigious Infrastructure Project – UK: Provided expert programming and delay advice to a consortium undertaking a prestigious £800 million infrastructure project to assist in managing live programme risks, and extension of time claims with the client.
- Defence Project – UK: Scott was appointed as the delay expert to independently assess the delay impacts to a defence project due to external influences.
- Public Sector Building Project – UK: Appointed as the independent delay expert witness in a litigation between a special purpose vehicle and a UK public sector body over the cause of delays to the construction of a group of building projects.
- Tunnel Project – Hong Kong: Advised on the delays to the construction of a large tunnel.
- Offshore Wind Farm Dispute – Germany: Appointed as the independent delay expert for a German Dispute Adjudication Board (DAB) hearing into delays to the construction of elements of an offshore wind farm. This included giving oral evidence on two occasions to the DAB, which was conducted under German law.
- Building Project – the Middle East: Acted as the independent delay expert witness on a dispute between a developer and main contractor concerning the construction of circa 350 luxury villas.
